28.1
The arbitral tribunal shall establish the facts of the case that are relevant and material for deciding the dispute.

For this purpose, the arbitral tribunal may, inter alia, on its own initiative, appoint experts, examine fact witnesses other than those called by the parties, and order any party to produce or make available any documents or electronically stored data. The arbitral tribunal shall apply the provisions of Article 9 and Article 15, mutatis mutandis, to any tribunalappointed expert, provided, however, that the arbitral tribunal shall assume with respect to the expert the function that the DIS has with respect to the arbitral tribunal.
